Terms and Conditions

This article only applies if the Client is a natural person who is not acting in the exercise of his profession or business. Business Customers are therefore not entitled to a right of withdrawal.

The general conditions apply if you place an order through our Website Sail360 established in Kaag and registered with the Chamber of Commerce No. 65,987,152.
All offers agreements and deliveries of Sail 360 are delivered under The General Conditions , for navigation and communication we refer to the Guarantee and delivery conditions of FURUNO unless otherwise agreed in writing. The content of the website has been carefully compiled, we can not guarantee that all information on the website at all times is correct and complete it is also subject to typing errors.

Prices and information

On the Sail360 website are the prices quoted inclusive VAT.
The prices include shipping and are without any costs in Europe for orders above  € 100.00.
The delivery costs are always shown in the basket at the end of your order. For goods that have been sent for free and that have been returned, €10.00 administration costs / packing costs will be deducted from the total amount to be refunded by SAIL360.

  • Furuno items with a price below €100.00 have an extra storage in addition to shipping costs this handling fee is €15.00
  • If the Furuno order is €100.00 or more the shipping costs and extra handling costs expire.

Netherlands / Belgium and Germany
• Small items, such as clothing and accessories will not be sent without charges: Costs for Sending           €14,90

France / Denmark/Austria/Luxembourg/Denmark/Sweden/Italy

Good to know:
If you order parts which will be delivered for whatever reason, Sail360 pays the additional costs, you pay only once for the delivery.
If you order items from multiple product groups, you pay only the delivery of the highest tax bracket.

Agreement
The Agreement is concluded at the time of acceptance by the Customer of the offer of Sail360 and fulfilled the prices set by Sail360. Sail360 will send a digital invoice. If the money is received by Sail360, Sail360 will send the products as soon as possible. The delivery time is reasonably between 2 and 7 business days. The maximum delivery time is 10 days.
The mode of delivery can be made in different ways and is the choice of Sail360.
If the products can not be delivered within the agreed period, Sail360 shall inform Customer. The customer may then agree on a new delivery date if he-she gets the opportunity to terminate the Agreement without charge or choose another product.

Payment
Customer must do payments to Sail360 according to the ordering process and on the website specified payment methods. If the Customer fails to fulfill its payment obligation (s) above, is that, after he was informed by Sail 360 on the late payment after the failure to pay within this 14-day period, the statutory interest on the outstanding amount also has to be paid . If payment is not forthcoming Sail 360 will give the collection agency the invoice for collect the outstanding.

Registration
To make optimal use of the Website, the customer can register via the registration form on the Website.
During the registration process the customer chooses a username and password, he can log in after registering on the Website. Customer is responsible for selecting a sufficiently reliable password.
Customer must keep his credentials as username and password strictly confidential. Sail360 is not liable for abuse of login data and assumes that a customer who registers on the website is actually the Customer. All of which is done through the account of the Customer, is under the responsibility and risk of the Customer.

Returns

This article only applies if the Customer is a natural person who does not act in the exercise of his profession or business. Business Customers therefore have no right of withdrawal.

If goods will be returned by the customer, prepaid amounts will be refunded as soon as possible but no later than 14 days after termination of the Agreement and receipt of the goods. The goods must be returned in the packaging obtained by the customer and in perfect condition and unworn. It is of course possible to fit clothing, but not to install equipment. The amounts are refunded to the Customer in the same way that the Customer has paid the order to us. For goods that have been sent for free and that have been returned, €10.00 administration costs / packing costs will be deducted from the total amount to be refunded by SAIL360. Products and spare parts that are specially ordered or modified for you will not be taken back.

Parts or navigation equipment ordered especially for you a natural person, as well as electronic maps, cables cannot be returned or replaced by other equipment.

For return, you must send a written notification to Sail360 that can be sent via a ticket or an email stating your order number and name, after which you will receive an answer within 24 hours and SAIL360 will tell you to which address you can return the product. Warranty and conformity
Sail360 guarantees that the products meet the agreement.
If the delivered product does not comply with the Agreement, Customer must within a reasonable time set an email notification to Sail360 when customer has discovered the lack thereof. If the complaint is founded, restored the relevant products after consultation with Customer will be replaced or refunded.

Liability
The total liability of Sail 360 to Customer in the performance of the Agreement is limited to compensation of up to the amount of the price stipulated in the Agreement (including VAT).
However, in no case shall the total compensation for direct damage will exceed €200.
Liability of Sail 360 towards the Customer for indirect damage, for consequential damages, lost profits, lost savings, loss of data and loss due to business interruption as well as others is excluded.

Retention
As long as Customer no full payment has made for the entire agreed amount, all delivered goods remain the property of Sail360.

Personal data
Sail360 process the personal data of the Customer in accordance with the privacy policy published on the Website.

Final provisions
1 The Agreement is governed by Dutch law.
2 Unless otherwise prescribed by mandatory law, any disputes that may arise from the Agreement will be submitted to the competent Dutch court in the district where Sail360 is located.
3 If any provision of these Terms is found to be invalid, this will not affect the validity of the entire Terms and Conditions. The parties will in such case replace , what as far as legally possible to the intent of the original provision is shaped.
4 "in writing" is also defined as communication by email and fax in this agreement, provided that the identity of the sender and the integrity of the mail is sufficiently established.
